Terms of Service

These terms govern your use of topsico.com and our text messaging program. By using this site, submitting the inquiry form or exchanging messages with us, you accept them.

1. Acceptance

These Terms of Service are an agreement between you and TOPSICO LLC, a Tennessee limited liability company. If you do not agree with them, please do not use this site or our messaging program. Our Privacy Policy is part of these terms.

2. What we are and what we are not

TOPSICO LLC buys residential real property for its own account. We are principals, meaning we buy for ourselves, and we may resell, assign or hold what we buy.

We are not licensed real estate agents or brokers. We do not represent you, we do not list property, we do not market property on your behalf and we owe you no fiduciary duty. If you want representation or want your property exposed to the open market, you should engage a licensed agent, and in many cases that will get you a higher price than selling to a buyer like us.

3. Nothing here is an offer

Nothing on this website is an offer to buy any specific property. Any number we discuss with you by text, phone or email is a preliminary indication based on the information available to us at the time. It may change once we learn more, and it is not binding.

No agreement to buy or sell exists between us until a written purchase agreement is signed by both parties. Submitting the inquiry form does not obligate you to sell anything and does not obligate us to buy anything.

4. Text messaging program

Consent

By providing your phone number and checking the consent box on our inquiry form, you agree to receive text messages from TOPSICO LLC at that number regarding the property you contacted us about, including messages sent using automated technology. Consent is not a condition of any purchase or sale.

Frequency

Message frequency varies and depends on our conversation with you.

Cost

Message and data rates may apply, based on your plan with your mobile carrier. We do not charge you for messages. Check with your carrier about your plan.

Opting out

Reply STOP to any message to stop receiving texts at that number. We will send one confirmation and then stop. You can also email hello@topsico.com to be removed.

Reply HELP to any message for assistance, or contact us at hello@topsico.com or at the address below.

Carriers and delivery

Mobile carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed and depends on your carrier, your device and network conditions. Supported carriers may change without notice.

Your number

You confirm that you are the subscriber for the number you give us, or that you are authorized to give consent for it. If you give up that number, tell us promptly at hello@topsico.com so we do not message its next holder.

5. Information you give us

You agree that what you tell us about a property is accurate to the best of your knowledge, and that you are the owner or are authorized to discuss and sell the property. If you are an heir, executor or representative, you agree you have or are seeking the authority you need. We rely on what you tell us when we work out what we can pay.

6. Acceptable use

Do not use this site to break the law, to submit someone else's information without their permission, to submit deliberately false property information, to attempt to gain unauthorized access to our systems, or to interfere with the site's operation. We may decline to work with anyone and may block access to the site.

7. Site content

The content of this site, including its text, layout, logo and images, belongs to TOPSICO LLC or is used with permission. You may read it and share links to it. You may not copy it for commercial use without our written permission. The TOPSICO name and logo are our marks. Photographs on this site are illustrative and do not depict specific properties bought or sold by us.

8. No professional advice

Nothing on this site or in our conversations with you is legal, tax, accounting, financial or real estate advice. Selling property has legal and tax consequences that depend on your situation. Talk to your own attorney and your own tax professional before you sign anything.

9. Disclaimers

This site is provided as it is and as it is available, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the site will be uninterrupted, error free or secure, or that any information on it is complete or current.

10. Limitation of liability

To the fullest extent the law allows, TOPSICO LLC and its members, managers and agents are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of your use of this site or our messaging program, whether the claim is based in contract, tort or anything else, even if we were told such damages were possible.

To the fullest extent the law allows, our total liability for any claim relating to this site or our messaging program is limited to one hundred dollars. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Governing law

These terms are governed by the laws of the State of Tennessee, without regard to its conflict of laws rules. Any dispute relating to this site or our messaging program will be brought in the state or federal courts located in Shelby County, Tennessee, and you and we consent to the jurisdiction of those courts. This section applies to the site and the messaging program. A signed purchase agreement will have its own terms, and those control the transaction.

12. Changes

We may update these terms. The new version will be posted here with a new effective date, and it applies from the date it is posted. Continuing to use the site after that means you accept the update.
